Trademarks in Poland from April 15, 2016.

From April 15, 2016 in Poland the procedure of prtection obtaining for the trademark is similar as in European Union Intellectual Property Office (EUIPO) in the case of registration of European Union trade mark. Procedure starts by filling a trademark application with Polish Patent Office. The Polish Patent Office will publish the trademark application in the Biuletyn Urzędu Patentowego (BUP) that is the official journal of Polish Patent Office and in electronic database of the PPO in the period of 2 months from the date of mark application (it is possibility to file the trade mark in electronic form) and in the period of 3 months from the date of publication all parties can file opposition if the trademark is similar or identical to the trademark used or registered in Poland. Polish Patent Office will register the trademark and grant the right of protection in Poland if no one file the opposition in mentioned period.
