Opposition in Poland.....formal requirements.

Materials which should be prepared in advance. The POA along with a document certifying that the person who signed the POA had the authority to sign documents on behalf of the company on date of signature. Most frequently, the documents filed with the Polish Patent Office are extracts from the Register of Companies, but notarised declarations or minutes from company shareholders’ meetings are also accepted. Any documents in a foreign language require a sworn translation into Polish. NO LEGALIZATION REQUIRED, but is acceptable. The POA with apostille is acceptable. Preferred method to file the POA with the Polish Patent Office: - a Power of Attorney (POA) along with an extract from the Register of Companies certifying that the person who signed the POA had the authority to sign documents on behalf of the company on date of signature.

All information about the classes of protection and about the usage in EU or in Poland and the graphical representation of the trademark in the case of graphical trademark or graphical trademark with word elements. Numbers of registration in Poland or EU or publication numbers of all the disputed trademarks.

Official fee: 1000 PLN and official fee for the POA 17 PLN

The procedure usually takes from 7 to 12 months (this term includes procedure before Polish Patent Office).
